Terms of Service

1. Who we are

The Sports Academy ("we", "us") is a Kenyan platform that helps parents discover, nurture and protect their child's sporting and academic pathway. By creating an account you agree to these Terms.

2. Eligibility & the role of the parent

Accounts may only be created by a parent or legal guardian aged 18 or older. Children do not own accounts — every child profile is created and controlled by their parent.

3. What you may use the platform for

  • Assessing your child's interests, strengths and motivations.
  • Receiving age-appropriate content, role-model stories and weekly drops.
  • Sharing progress with coaches, mentors or schools you explicitly invite.

4. What you may not do

  • Impersonate another parent or create profiles for children you do not have legal authority over.
  • Attempt to extract or resell our content, reports or assessment materials.
  • Use the platform to harass, recruit or contact other families.

5. Subscriptions and payments

Paid features require an active subscription or one-time purchase processed through Paddle, our Merchant of Record. Prices are displayed in Kenya Shillings (KES) or US Dollars (USD) as applicable. Paddle handles billing, tax, and receipts. Card subscriptions may auto-renew until cancelled; M-Pesa prepaid periods do not auto-renew. You authorise Paddle to charge the applicable fees on our behalf. You may cancel at any time and retain access until the end of the billing period. Refunds are governed by our Refund Policy.

6. Payment processing & Merchant of Record

Our order process is conducted by our online reseller Paddle.com Market Limited ("Paddle"). Paddle is the Merchant of Record for all purchases made through The Sports Academy. This means:

  • Paddle is the legal seller of record for your transaction.
  • Paddle processes your payment, handles applicable sales tax and VAT, and issues your receipt.
  • Your payment details (card number, billing address) are collected and processed by Paddle directly — The Sports Academy does not store your card details.
  • Paddle provides payment-related customer support. For billing enquiries, contact Paddle directly or email sportsparentingforum@gmail.com and we will liaise with Paddle on your behalf.
  • Paddle's terms and privacy policy apply to payment processing: paddle.com/legal.

By completing a purchase, you agree to Paddle's terms of sale in addition to these Terms.

7. Liability

We provide guidance, content and pathway recommendations — not guarantees of athletic outcomes, scholarships or contracts. Decisions about training intensity, schools and competitions remain yours.

8. Termination

You may delete your account at any time. We may suspend accounts that breach these Terms or place children at risk.

9. Intellectual Property

All content, materials, assessments, reports, curriculum, software, design, branding, and trademarks on The Sports Academy platform are owned by or licensed to The Sports Academy and its founder, Maxwell Kering'. You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any content from this platform without prior written permission.

Content you upload (such as a child's animal avatar selection or assessment responses) remains associated with your account for the purpose of delivering the service. By using the platform, you grant The Sports Academy a limited, non-exclusive licence to store and process your submissions solely to provide and improve the service.

Third-party content (including YouTube videos, external course links, and sports data) is the property of its respective owners and is displayed under fair use or embedded via official APIs. The Sports Academy claims no ownership of third-party content.

10. Governing law

These Terms are governed by the laws of the Republic of Kenya.
